I went to the doctor, and his diagnosis was that I have bronchitis. He gave me antibiotics and cough syrup He said get plenty of rest, so I won’t be back at school until Monday. At least it’s at the end of the week, so I have some extra time to recover.

It’s Cold and Sinus Time
This is the night-time sniffling, sneezing, coughing, aching, stuffy head, fever, so-I-can-go-to-bed-early last night post.
HRH
Most people who do not like cats do so because of some stereotypes associated with owning a cat, including ones that they are snobby, nasty, boring, and have really no interest in being around people except when they want food and water. Cats are often seen as aloof animals who only do what they want to do when they want to do it. The above generalizations actually apply to very few cats. Of course cats like to have some “alone time” every now and then (Who doesn’t?), but just like people, cats have their own unique personalities, so their temperament and socialization depend quite a lot on simply “how they are.”
HRH is my faithful companion. By the way, the above picture is an actual picture of her. Over the years we have become very attached to one another. Though she may have a bit of attitude at times, especially around people she’s not familiar with, she’s often a very gentle cat, as long as she is treated well. She’s a bit finicky at times. She will only eat dry cat food, she wants her bowls to be full, and she refuses to eat crumbles. She also has a fairly strict routine each day. She’s up around 6 am each day, no later than 7 am, and she is ready for bed at 10 pm. She nearly always sleeps through the night, often beside me in the bed. During the day, it’s all about eating and catnapping.
Whatever anyone may say about HRH, she’s and empathetic and intelligent cat. She has learned how to manipulate humans into getting what she wants. And the part that makes her such a wonderful companion is her empathy. She knows when I am sad or when I’m sick. When I have a headache, she seems to able to sense it. She will come up to me and gently pat my head with her paw or rubs her head against mine in an attempt to comfort me. If she notices me tossing and turning at night have a hard time falling asleep, then she will often crawl up on top of me and lay down, so that I will stay still and fall asleep. Now she probably only does this because my tossing and turning disturbs her, but she’s learned how to calm me down.
Overall, she’s a wonderful companion. The picture above is from when I had my headache. She was sleeping quietly beside me making sure that I was alright. Occasionally, she’d even get up and pat my head with her paw, as a way of saying, “Get well, my friend.”
Migraine
It is not that unusual for me to have a headache. I have them all the time, almost daily, but I’ve learned to live with them and do what I need to do. I also have migraines on occasion. If you’ve ever had a migraine, then you know it’s not your usual headache. The pain is debilitating. When I have a migraine, my senses become hypersensitive, especially to light, sound and smell, though touch and taste can also be affected.
I say this because for the past two days, I have had one of the worst migraines that I can remember. Migraine specific medicine and strong pain relievers can mask the pain for short periods, but so far it has not cured the pain I am experiencing. I even had to take a sick day at work yesterday. (I very rarely take sick days. Most often I work through an illness.) I had taken some medicine before I left for school hoping that it would kick in by he time I got there, but I was mistaken. The pain only grew worse. So, once there, I arranged for a substitute, got some work together for my students, and went back home to bed and stronger medication that would allow me to sleep.
Thankfully, I woke up and my headache is mostly gone (these really bad migraines usually last 24-72 hours and luckily I only get then 2-3 times a year). I have a shadow of the headache still, in which the pain is considerable less but still there, and I can go about my day at school. I hate being sick and preparing for a substitute. When I can prepare ahead of time, I can make sure that I am in a good stopping place and can have worksheets, reading assignments, or a film for the students to watch. However, when I am in the middle of a series of lectures, it is nearly impossible to prepare for a substitute.
The Fraudulent Practices of DirecTV
When I was a young kid growing up in rural Alabama, there were two ways to get television reception. The most common way was with either rabbit ear antennae or with a large outdoor antennae. With this method, people in my area could receive NBC and later CBS easily (when I was a little kid, CBS switched from UHF to VHF). By moving the antennae just to the right spot, you could pick up ABC and sometimes PBS. Only later did Fox come along. The other option was to get one of those large satellite dishes that moved to capture the reception from different satellites. The problem with the large satellite dishes is that there could be nothing around them to block their reception and often they were struck by lightening. They were also quite expensive to buy.
So in the early 1990s when PrimeStar came along, you could get a small stationary 3 foot satellite and get most of the popular channels that people could get with cable television in urban areas. My parents, who had at one time had one of the large satellites, and my grandparents, who only had an antennae, got a PrimeStar satellite receiver. Finally, we had more than four channels. However, in 1999 PrimeStar was bought out by DirecTV and put out of business. For rural television viewers, we now only had two choices DirecTV and Dish Network. My grandfather bought the equipment to change over to DirecTV and after his death my aunt kept DirecTV, but as DirecTV began to upgrade equipment and offer free DVRs, they refused to upgrade my aunt’s equipment or provide us with local channels. (I had moved into my grandparent’s old house by this time.)
Finally, in November 2012, we cancelled the old contract, planning to go to Dish Network. In the process of doing so, we received an offer from DirecTV that we couldn’t refuse. We were offered two free DVRs, local channels, and their Choice Xtra package for $57.99 a month. I called to get the service set up the new service since they wanted us as customers back. When I called, we were assured that the price would be $57.99 per month. I specifically asked if it would go up in 12 months. I had dealt with these kinds of companies before, and I knew what to ask. I was assured that not only would it not go up after 12 months, but that after 12 months we would receive an additional $10 a month discount and our monthly bill would be $47.99 for the remaining year of our contract. So I agreed, and the next Monday, they came to set up our service.
That should have been it, with taxes and fees, we should have paid $66.94 a month for 12 months, and then paid roughly $56 for the next 12 months of our contract. However, this was not the case. Each month I have received a bill, the amount has been incorrect. I have called and been assured that it the previous monthly rebates we were getting would be reinstated because they had been mistakenly removed. Yesterday, however, parts of our service was cut off with a message to call customer service. So I did, only to find out that we owed $144. The rebates I kept being told that we were being given to keep our bill at the original price (not even including the additional $10 rebate we were originally promised), had not been applied and the charges have been adding up without our knowledge.
After two hours and seven (yes, 7) customer service representatives, I am finally told by one that informed me that every customer service representative that I have talked to over the past year, including the initial one who set up our account, had lied to me. She laughed at me for believing them, and said that there was nothing I could do. How wrong she is, because this is only the beginning. She doesn’t understand that I made a New Year’s resolution to be more assertive and not take things lying down anymore. I will continue to fight the fraudulent practices of DirecTV, and I will spread the word.
When all was said and done, one representative (the fourth I talked to) had admitted to me that this was standard practice with DirecTV and his own grandfather had been complaining to him about it. This nice young man told me to request that the original phone call be pulled and listened to so that they would honor the original agreement. According to the DirecTV representative, they really do record all phone conversations for quality assurance and training purposes. The dispute process takes 2-3 weeks, but the call can be pulled. However, the last representative who was supposed to be able to do this, told me not only would she not pull the phone call, but that she could not. They kept the phone calls and they were used for training purposes but it did not matter what was originally agreed to, DirecTV would never ever honor it.
Basically, if you decide to do business with DirecTV, you can be guaranteed two things. One, they will promise you the world in order to get you to sign a two year contract. Two, they will not honor that original agreement because there isn’t enough competition for them to have to do so. So this is my advice to anyone who lives in rural America: do not conduct business with DirecTV. Dish Network may not be the best service, especially if you like sports, but having dealt with them in the past as well, if you have a problem, Dish Network will do their best to resolve the issue to your satisfaction. On the other hand, DirecTV will give you all sorts of promises, and will not honor their agreements. They will continually commit fraud, false advertising, and their representatives will continually lie to you in order to get you off the phone, so that you will have to call back on another day and speak to someone else.
DO NOT CONDUCT BUSINESS WITH DIRECTV!!!!!

Consumer protection lawsuits and violations
Washington State’s Attorney General civil complaint
On December 14, 2009 the Washington Attorney General’s office filed a civil complaint against DirecTV seeking injunctive and other relief. The complaint was filed in the public interest when the Attorney General’s office determined after a one-year investigation by its Consumer Protection Division, that the company allegedly engaged in numerous repeated violations of the state’s Consumer Protection Act.
The complaint alleged unfair or deceptive practices which include, but are not limited to
Unclear disclosures concerning rebate terms and conditions,
Unclear and/or unfair advertising for use of the term “free”;
Automatically extending contracts when customers require equipment repairs, upgrade equipment or move;
Failing to disclose finance terms and conditions that the company’s least expensive package of $29.99 per month is only available to customers who meet certain financing conditions and agree to have the costs automatically charged or debited.
The suit also alleged that some cancellation fees assessed by the company were considered to be unfair, and
That the company unfairly retained consumer deposits made to obtain services. Those who cancel service prior to the end of their contract lose part of the deposit and may also be charged cancellation fees.
The Attorney General’s Office asked the court to compel DirecTV to change its business practices, impose civil penalties and provide restitution for consumers.
The case was settled in December 2010, with Directv agreeing to pay over one million dollars, and to correct many of its business practices. 47 other states joined in a similar suit, the settlement of which required Directv to pay over 13 million dollars.
California class action lawsuit
In September 2008, consumers filed a class action lawsuit with the Los Angeles Superior Court to stop DirecTV’s practice of charging early cancellation penalties to subscribers. The lawsuit claims that DirecTV fails to disclose the penalty to new customers or to existing customers who replace their equipment or add a new receiver, and that these practices are unlawful. In September 2009, a motion for a preliminary injunction was filed to block the company from automatically removing the fees from customers’ bank accounts or charging their credit card accounts without their prior knowledge and written consent until the lawsuit is resolved.
Telemarketing violations
In December 2005 the U.S. Federal Trade Commission imposed a $5.3 million penalty on DirecTV for its violations of federal telemarketing regulations. It was the largest civil penalty the FTC had ever announced in a case enforcing any consumer protection law.
Hell Froze Over
Well, Alabama froze over, which sometimes is close enough to hell for me. It sure feels like it in the summer months. I had planned on writing more, but I usually write my posts the night before and I’m sleepy as I write this one. I might add to it later this morning.

We don’t often get this type of weather here in Alabama. Yes, we generally get at least some snow once a year, but rarely is it considered a “winter storm.” I’m not sure how bad this might be, and I actually expect it won’t be much of anything. Yet, two inches of frozen precipitation can wreak havoc here, since we are not accustomed to icy road conditions.
Sometimes in icy conditions we lose power, so we will definitely get some gas for the generator, and I plan to cook a large pot of corn and potato chowder to warm things up in the chilly days ahead.
The worst part about Alabama winters is not the cold, but the extreme fluctuations in temperature. Yesterday, we had mild temperatures in the 60s and tonight it will drop to 28 degrees. The extreme swing in temperatures gets everyone sick.
When in the South, you get used to weird weather. Like most things in the South, you just have to deal with the eccentricities, whether they’re from family, friends, or Mother Nature.
Went to Bed Early
Last night, I was so sleepy, I could barely keep my eyes open past 8:30 pm. Sean (Just a Jeep Guy) had suggested I write a piece about the popularity of bareback videos in gay porn. I had planned to write that post for today, but just couldn’t hold my eyes open. After getting home from school late, then cooking dinner (which I do nearly every night, but tonight it was risotto, which takes a bit of effort to cook), and doing laundry, I knew I couldn’t hold my eyes up long enough to write the post that I had planned to write. I feel asleep, and thus, this is the part for today.
I guess I can hope the old saying is true: “Early to bed, early to rise, makes a man healthy, wealthy, and wise.”
“Noel” Will Return to School
A story made its rounds on the Internet (including this blog) this weekend and on Monday after a Florida high school allegedly suspended a senior “Noel” (I am going to use his Sean Cody name not his real name, which is easy enough to find if you want to do so) when the principal discovered the student had appeared in multiple gay porn movies on popular site Sean Cody.
Noel makes no apologies for performing in porn and considers his work like any other job, and quite honestly, I have to say, he does have the body for porn, if you know what I mean. Until two weeks ago, the 18-year-old (he turned 18 in June 2013) was like any other high school senior, but he said when students at Cocoa High School discovered his videos on an adult website, they started showing each other his explicit pictures on their phones at school.
The move by the public high school sparked outrage on social media, causing students to rally behind Noel through Facebook groups and campus demonstrations.
Now, it is being reported that following an investigation school administrators are allowing Noel to return to school grounds — though they reportedly won’t give an exact reason for the suspension, citing privacy laws.
“It’s easy to become emotional about a situation when it looks like a student is being targeted for his lifestyle choices, that is not the case here,” school district spokeswoman Michelle Irwin told reporters. “We will continue to work with the student and his family to make sure he graduates and moves on with his education.”
“No child would ever be suspended for a job that they have outside of the school environment,” said Irwin. However, when reporters asked why then he was suspended, administrators said they received information that Noel made threats, after students found pictures of his work online and started to taunt him. “In this particular case, we had an investigation, which is now complete, and the student is welcomed to come back to talk to Dr. Sullivan about his educational options,” said Irwin. Reporters checked with Cocoa police, they confirmed they did investigate the alleged threats but found nothing.
Noel’s mother said she knew her son was working in adult films, adding that he took the roles to support her financially. “I think he’s the most awesome person in the world,” she said tearfully. “He stood up and he was the man of the house when I couldn’t be.”
His mother also told reporters that she believes her son’s work in adult films is why school administrators suspended him. “She [Dr. Sullivan] flat out told me that my son was expelled not just suspended,” his mother reportedly stated. “He was expelled due to his explicit, adult, lifestyle career.”
Cocoa High Principal Stephanie Soliven called Noel on Tuesday morning — after the holiday weekend — and they worked out a plan to get him back to class, Irwin said. Noel said the principal “apologized to me and said the threats were made up (by other students).” District officials confirmed the investigation had been concluded and Noel was cleared.
The discussion between principal and student was according to district policy and unrelated to a flurry of furious Facebook comments and feedback the district received from around the globe after the story broke last week, Irwin said. She did not have the policy immediately available.
Because Noel is an adult, he did not appear to violate obscenity laws, Assistant State Attorney Wayne Holmes said. “We’re basically in a society today where consenting adults can do what consenting adults want to do,” Holmes said, adding that the community standard for what is obscene has changed with the increased use of technology and the Internet. “What 30, 40, or 50 years ago may have been a crime, you can now go to a local movie theater and see.”
Noel shuffled his bare feet through dry pine needles carpeting the cement walk outside his home while speaking Tuesday with Florida Today. He slumped his muscular, 5-foot, 9-inch frame, hung his blond head and avoided eye contact. “I’m just ready to return to school, like a normal day,” Noel said Tuesday. He was anxious though on the eve of his return to class, behaving nothing like Noel, his bold online personality as a gay pornography model. He knows that returning to Cocoa High School will be anything but ordinary given his unusual job, taken to help out his mom because his dad doesn’t work. “It’s just her trying to feed me and the dogs and pay bills,” Noel said, rubbing his hand across his face.
A number of porn stars have faced disputes within school systems whether they were active in the adult film industry or not. In 2010, Shawn Loftis — who directed and acted in a series of gay porn films under the name Collin O’Neal — was dismissed from a substitute teaching gig in the Miami area after a principal discovered his films on a website. The following year, however, the Florida Education Practices Commission ruled that Loftis would not only be permitted to teach, but was also eligible to apply for a permanent position as an educator.
Meanwhile, Kevin Hogan, who allegedly starred in at least three X-rated gay films under the name “Hytch Cawke” before being hired at a Massachusetts charter school, was placed on administrative leave in 2011 when his previous gig was revealed.
Frankly, it sounds to me as if the principal was advised that she had made a bad decision and one that she would be unable to back up legally. I think she made a rash decision based on her own morality, while ignoring what school procedures were. Instead of helping Noel, she hoped the kid would go away quietly and the whole matter would be swept under the rug. When this did not happen, she ended up eating a bit of crow. I do wonder if their will be further consequences for her behavior or if the matter will be forgotten soon because she allowed Noel back in school.
I also believe that Sean Cody should be a little more hesitant to accept high school students. Sean Cody has the responsibility [at least morally] to absolutely make sure these 18 year olds fully understand the possible ramifications of doing porn. Teens are not usually mature enough to think past the next month let alone their entire future. Noel did this for his family and according to his mother with her knowledge. Though I realize that pornography and prostitution are not the same and here is a fine line between the two, isn’t this at least a little akin to a parent telling their eighteen year old daughter that it is okay to go sell herself on the street in order to bring in more money for the family? I do realize that in the case of prostitution, it is illegal in most places in the United States, whereas pornography is not.
Sean Cody has been known for some unscrupulous practices in the past. They often have models sign exclusive contract that have at least a year long clause which prevents the model from working elsewhere and they refuse to allow the model out of the contract even when they decide they don’t want to use the model anymore. Furthermore, Sean Cody has become an almost exclusively bareback (condom free) studio (Noel did five videos with Sean Cody, all bareback, though one was a solo video), which presents health risks to the models, no matter how much testing they go through. In all honesty, I will admit that I did once have a subscription to SeanCody.com, but as they increasingly began producing more and more bareback videos, I became uncomfortable with supporting their enterprise, and cancelled my membership. I am not judging those who enjoy bareback porn, in fact I too find it rather hot, but it’s a conundrum to me because I don’t like it, yet I do. Bareback porn makes me feel guilty for watching it because I know the models are being put at risk and that it sends the wrong message, and I don’t like feeling guilty for watching pornography.

Pallbearer
My original plan today was to be disembarking from a cruise ship at Isla Roatán in Honduras. However, since my cruise was cancelled due to my aunt’s death, I will be serving as a pallbearer at her funeral instead of taking a historical tour of Roatán and getting in some beach time.
For those of you who may not know, a pallbearer is one of several funeral participants who helps carry the casket of a deceased person from a religious or memorial service or viewing either directly to a cemetery or mausoleum, or to and from the hearse which carries the coffin.
A pall is the heavy cloth that is draped over a coffin. The term “pallbearer” is used to signify someone who bears the coffin which the pall covers.
In western cultures, the pallbearers are usually male family members, close friends, or colleagues of the deceased. A pall-bearer in the USA will carry a casket by the handles, and at around waist height. In the United Kingdom, the casket is carried on the shoulders, and the handles are for the most part decorative. All lifting should be done from underneath the casket.
I realize that this is a somewhat somber post, and it’s quite a somber time for me and my family. I just did not feel like righting a cheerful post today, so I hope you will forgive me.
P.S. HRH seems to be enjoying being home. I’m sure after being kept in a kennel for a week, she is happy to be able to roam around some, though she’s mostly resting. Quite honestly, sleeping is what cats do most of the time anyway.
